The consequences of Getting a Traffic Ticket in New york

Receiving a traffic ticket in New york has financial consequences beyond the cost of the ticket itself. In addition to the fines, your insurance company can increase your rates and you can be assigned to the New York Driver Responsibility Assessment program which will cost you a minimum of $300. Fortunately, there is a way to reduce both your points and insurance costs by attending an approved Point and Insurance Reduction Program (PIRP) driving safety course but there are some things you need to know about the program before registering.

The consequences of getting a ticket in New york

In New york, a driver who receives six or more points on their driving record within an 18 month period must participate in the Driver Responsibility Assessment program. This assessment will cost a driver $100 per year over a three year period. For every point over six points, an additional $25 will be added. Failure to pay will result in suspension of your driver’s license.

Point Reduction

Attending an approved PIRP course will reduce the points on your New York driving record by up to four points. For someone who rarely gets or has never gotten a ticket, reducing those points can help insure that you will not go over that six point assessment limit should you get another ticket within an 18 month period.

There are two important notes to remember when trying to reduce your points:

The PIRP program is only good to reduce points on tickets received within the 18 month period before you attended the course. You cannot use the course as a “get out of jail free card” to reduce points that you may get in the future and you can only attend the course once in an 18 month period; points for tickets received within 18 months after attending the course will remain on your record.
If you have already been assigned to the Driver Responsibility Assessment program, you cannot use the PIRP program to reduce the points and get out of paying your annual assessments.
Insurance Cost Reduction

Insurance costs can be reduced by 10% of the base price of your current insurance policy for three years by attending the PIRP course. As with the points however, there are a couple of things you should understand about insurance reduction.

The Insurance cost reduction only applies if the principal operator of the insured vehicle attends the course. For example; a teenager, whose mother is listed as the principal operator on the policy, borrows her car and gets a ticket; he cannot get an insurance reduction by attending the course.
Your Insurance company can still raise your rates due to a collision that was your fault or when the policy is renewed; the 10% reduction only applies to your current rates.

Traffic Tickets Are a Huge Unnecessary Expense

Traffic tickets can be more than just a major headache for people. They create what can become an ongoing expense. Tickets which are not paid on time, or at all will cause even more fees for interest as well as late fines. This just scratches the surface of the difficulties that may follow.

Individuals who have outstanding tickets can forget about receiving reasonable insurance rates. These people also may find themselves facing jail time. The result of course is the need for legal representation, and more money being spent. At this point, a person may be looking at bills costing thousands of dollars.

It is important for people to understand that speed limits have been put in place for a reason. This is to ensure the safety of everyone who is on the road. Obeying the speed limits can also save people money. When running late, many individuals feel that if they drive faster that they may still be on time. The truth is that this is one of the leading causes of automobile accidents, and they may be lucky if they arrive safely at all.

A lot of drivers treat their directional signals as though they are optional. Nothing is more aggravating than being behind a car, which is turning but does not let the person behind them know. This has been the cause of more than a few automobile accidents. Unfortunately, having an accident is the only thing that some people may learn from. For many, it is also too late.

Everyone has an occasion where they make a mistake. Someone may realize that they are driving to quickly only when passing a speed limit sign. Others may forget to turn on the directional signal when trying to find the right place to turn. Some may continue through a yellow light, thinking that they will not have time to safely stop. Every town has an area which is known to be a place were police hide and wait to find drivers who are doing something wrong. When these individuals are ticketed, they are usually told that it is to ensure their safety. This however doe not seem to have any large success is changing people’s driving habits.

When a person pays the fine for a traffic infraction, they have admitted that they are guilty. Once the fine has been paid, it is a done deal. It is always better to fight the charges and plead not guilty. Otherwise, a person can expect to have difficulty obtaining reasonably priced insurance. This is if they are able to become insured at all. Quite often, a judge will be lenient with a person who simply made an error, which is not habitual.

Because everyone is so busy these days, time truly is money. Putting off a court date can sometimes mean. Not being held responsible for ticket. A police officer will not have the time continue scheduling court appearances, which inevitably become delayed. More often than not in a case such as this. The police officer will not bother to show up for court date, and the case will be dismissed.

Biting traffic tickets can save a person a lot of money.

Traffic Tickets Will Affect Your Auto insurance

You need to understand that if you are driving on the roadways, you always need to be on the ball, alert and focused. Otherwise, you could find yourself not paying attention and driving too quickly, or driving recklessly and wind up seeing some lights pop up behind you. These lights can only actually mean one thing: you are being pulled over by the police. Let’s start with the fact that traffic tickets will affect your auto insurance rates.

You need to understand that there are actually several different things that you are going to want to learn and appreciate about the complicated time that can come from being pulled over and receiving a ticket. Through the upcoming paragraphs, you’ll get a look at what a ticket can actually do in a negative sense for car insurance rates and some points of interest towards decreasing the likelihood of getting a ticket in the first place.

One of the very first things that you have to realize is that for most people, a ticket acquired from operating a motor vehicle is kind of like a rite of passage. More people have had a ticket than have not, and that is something that can ease a mind if you are posed with a situation in which you are receiving a ticket for some transgression of the roadway.

You also need to understand the negative effects that receiving a ticket, or several of them, can have on the rate the company that is insuring your vehicle will then decide to charge you for this coverage. Depending on the nature of the incident, this company might likely charge you a good bit more on the rates you pay monthly or semiannually.

This is because, according to the company that is insuring the vehicle, you have eluded the status of being a safe driver. This is usually a black and white approach to things, as you are either a driver that has an unblemished record or one that has had violations which resulted in action from police. From speeding citations to fender benders, it’ll all detrimentally affect rates.

So how do you get back into the good graces of the company insuring you? Perhaps the easiest way to do this is to work hard to not get any more citations relative to your driving. The longer you go without incident, the more the rates decline and reach where they started at. They might even go lower than where you started, depending on the terms with which you initially became insured.

Avoiding getting a ticket might be as simple as just being more aware of the surroundings. You should avoid becoming distracted by things that you could have just as easily gone without until the vehicle was no longer in motion. This means cell phones, mp3 players, make up, the radio and more. These all provide unnecessary distraction and can avert attention from the roadway.

If you are, or were curious about how traffic tickets will affect your auto insurance rates, perhaps you have a better idea about this now. The best thing that you can do is avoid them by being a much more focused driver, but understand that with a ticket often comes a higher rate.

How long Does it takes For Traffic Tickets to Clear Off DMV Records?

Traffic Tickets and your Insurance

Very few people will go their entire life without at least one traffic violation on their record. When this happens, it can adversely affect your car insurance rates. There are some important things you need to know about your driving record and how it can impact your car insurance in the future.

Tickets

Tickets can range from moving violations such as speeding to non-moving violations like parking tickets. For the most part the only violations that will affect your automobile insurance are moving violations. Things like speeding and driving under the influence are at the top of the list. It is estimated that a speeding ticket can increase your insurance rates by as much as 25% for a first offense. On the outset that may not appear like a lot of money but when you consider that it will remain on your DMV report for up to three years you can see that it is a significant increase.

Department of Motor vehicles Report

Any of the above violations will be reported on your driving record. Some offenses will take points away from your license. The points system is a system by which offenses are rated as points and when you reach a specific number of points, your license may be suspended. For example, a speeding ticket in West Virginia can cost you five points on your license and should you reach 12-13 points you license may be suspended for 30 days. Some states will revoke all driving privileges for a chronic offender.

Your DMV driving record is something that you need to check every so often to be sure it is free of any errors. With the impact that it can have on your car insurance you do not want to be paying for an infraction that you did not commit. The cost and procedure for obtaining your DMV report may vary from state to state however, your local office should be able to assist you. In some areas, you will automatically get a copy anytime a business like an insurance company requests one.

How are Violations Removed

Depending on the severity of the violation and the state in which the violation occurred, many tickets can remain on your driving record or criminal record for three years or more. Violations such as DUI or vehicular homicide will be on your criminal record as well as on your driving record.

To remove violations from your driving record you can of course dispute any that are in error. For the rest you may have to simply wait them out, some states will credit you for taking a driving safety course.

These courses can also reduce the cost of your insurance. However, the courses themselves are not free so you will want to weigh the gains against the cost. The moral of the story is this if you want to keep quality insurance at an affordable price keep a close watch on your driving record, and if you do get into some hot water be sure and consult an attorney before paying your tickets. When paying a $50 speeding ticket you are admitting guilt and it will be on your driving record within 10 day. The fifty dollars in and of itself is not terrible but the resulting rise in your car insurance will be. Be aware of all these facts and take the appropriate steps to avoid them.

How to use a Mistake of Fact Defense With a Traffic Ticket

Mistake of fact is a situation which you may have in fact broken the law, but due to extraneous circumstances you aren’t held legally accountable. Sometimes though you still have to defend yourself in spite of not actually being liable to the crime.

How can you use a mistake of fact defense with traffic tickets?

You have to prove that there were circumstances beyond your control when getting your traffic ticket.

For speeding tickets one of the most common ways this can be used is because the speed limit sign is somehow blocked or gone. After severe storms a branch might cover the sign or it’s completely fallen over. In this case you aren’t trying to speed or do anything wrong. It’s a good idea as soon as possible to go back to where the speed limit sign is gone or blocked and try to take photos to defend yourself.

This also happens with tickets where you have failed to stop. For example a stop sign might not be there or the lines on the road are faded. Photo evidence will work the best when bringing this up to the judge.

For the most part judges should be understanding in cases where there are circumstances like these. You have to be careful that you don’t actually admit to the judge that you were breaking the speed limit as posted. Instead make the case that the city didn’t fulfill it’s responsibility to you as a driver.

In vary rare cases this defense can be used when speed limit signs are changed and you happen to one that’s pulled over that day. This isn’t a completely strong defense but it’s an option that you can use.

Car insurance Rates – How do Traffic Tickets, Accidents and DWIs Affect Your car Insurance Rates

Do you know the true cost of a traffic ticket, an accident or a DWI when it comes to your car insurance rates? Do you know how long these things can have an affect on what you pay for your insurance each year? These are offenses that insurance companies take into consideration when they are deciding how much to charge you for your insurance. They are all reasons that your insurance rates will go up and you need to know how much you can expect to pay if you get a ticket, have an accident, or get caught drinking and driving.

First, let us discuss traffic tickets. When you get a ticket for speeding, if it is your first, you can usually use the deferment program and pay the ticket. This means that as long as you do not get another ticket within a year the insurance companies will never find out that you got a ticket because it will be removed from your record. If you can use this program, then you should do so. If you have already used the deferment program, then you will have to report the ticket to your insurance and this will cause your rates to go up from 50% to 150% of your current premium.

It will make a difference if you were going 20 miles or more over the speed limit because that is considered wreckless driving and you will have to pay even more on your insurance premium.

Second, let us discuss accidents. Even an accident that is not your fault will raise your rates some. This is due to the fact that somehow you were in the situation where you ended up in an accident. This will not raise your rates too much, but if you have a few of them in a year or so period of time, then it will have a heavy effect on your rates. Now if you have an accident that is your fault, then you better be prepared for your rates to skyrocket. They will at least double and might even triple in some cases. Accidents are one of the worst things when it comes to your insurance rates.

Last, let us discuss DWIs. These are the worst for your insurance. Beside the couple thousand in court costs, lawyer fees, probation fees, and alcohol class fees that you will pay, you can expect your insurance to jump about 200% to 500% for the next year, then it will go down a little if you do not have any infractions. After about 3 years it might make it back down to where it was before, but it may take up to 5 years. This will most likely bring the total cost of your DWI up to around $5, 000 to $7, 000 when you could have taken a cab for under $50 or rented a hotel room for under $100. Instead you will pay for it on your car insurance rates.

Reasons why You may want to Fight Against That Traffic Ticket

Hardly any individuals will go their whole lifetime without having a minimum of one traffic ticket on the track record. At these times, it could possibly negatively impact your automobile insurance premiums. Ministry of Transportation Abstract

Any of the aforementioned infractions will probably be noted on your own abstract. Some violations will gain you points to your driver’s license. The points system is a method through which violations are graded and a number of demerits assigned so when you get to a selected number of demerit points, your license will be suspended. By way of example, a speeding ticket in Ontario for exceeding a speed limit by as much as 20 km/hr can set you back three demerit points on your license and in the event you arrive at 15 points you license will be suspended for thirty days period. It gets even more radical in the event of repeat offenders.

Your driving history is one area you’ll want to verify from time to time to be certain it really is clear of any mistakes. With the effect it can easily have on your automobile insurance you will not want to be spending money on an offense that you didn’t make. The price and process of getting your driving abstract are different from province to province nevertheless, the local office will be able to work with you. In certain locations, you’ll routinely obtain a copy whenever a company like an insurer demands one.

How Convictions Get Removed

Based on the seriousness of the infringement and also the province where the breach took place, quite a few traffic tickets can continue to be on your record or criminal history for 3 years or even more. Charges including drunk driving or vehicular homicide is going to be on your criminal history and also on your driving abstract.

To get rid of infractions out of your driving history you are able to obviously challenge any which might be in error. For the rest you might need to simply hang on until it disappears, some provinces will credit you when planning on taking a driving training course.

If you wish to maintain high quality insurance coverage at a reasonable cost continue to keep a close watch on your driving history, and should you end up in some trouble make certain and seek advice from a traffic paralegal before you pay your tickets. When paying out a $50 exceeding the speed limit ticket you will be acknowledging culpability and this will end up on your driving abstract with the ministry. The fifty bucks by itself is just not awful nevertheless the ensuing increase in your automobile insurance coverage might be. Be familiar with each one of these facts and consider suitable actions in order to avoid them.

5 Reasons You should Hire A Traffic Ticket Lawyer To defend You

So you got a traffic ticket and you are scared about what could happen. Depending on the offense, the results could be a suspended or revoked license or even jail time in extreme cases. The courtroom is no place to wing it and throw caution to the wind. This is why you should hire a traffic ticket lawyer and here are the top five reasons why.

1. Peace of mind. Usually, you have about a month or so before you have to appear in court for a traffic citation. During that time, your mind races and you come up with every bad outcome that can happen. Will i go to jail? Will i get a big fine? Will I be able to keep my license? All of this may keep you awake and affect your health. All of this can be taken care of by hiring an attorney. He/she will know the most likely outcome and the maximum punishment you may incur. Your chances of getting a lesser punishment are greater when you hire a lawyer.

2. Better chance of winning your case. This is probably the single most important reason you should hire a lawyer. When you show up to court with representation, the judge sees that you really BELIEVE you are innocent. The lawyer knows the court’s language and can probably win your case quick.

3. If you do happen to lose the case, getting your appeal is more likely when presented by a lawyer. Judges are funny creatures. They have all the power and they know it. Having a traffic ticket lawyer by your side makes all the difference to that judge. Cases are still lost and there is no guarantee of victory. You can still appeal and a traffic ticket lawyer has a better chance to win that appeal and have the offense expunged from your record.

4. Cost is lower. In many cases, the cost of hiring a traffic ticket lawyer is much less than the fines you may be liable for, should you lose. In either case, attorney’s fees do not go into the public record like fines and penalties do. In other words, your record stays clean.

5. A traffic ticket lawyer handles arbitration and litigation more effectively. In cases where you may need to argue the charges, it is always better to have an experienced lawyer doing the talking. His can shield you from inadvertently saying something that constitutes contempt. You should hire a traffic ticket lawyer for this reason alone. He or she may be able to persuade the prosecutor and judge to give a lesser decision, lower fines or toss the case altogether.

All of these are great reasons to hire a lawyer. We, as ordinary citizens, do not know the inside of the legal system like an attorney does. If positive results are what you need, you need to hire that lawyer immediately. It could literally mean the difference between keeping your license and not being able to drive at all. It may even keep you out of jail.

The key to Using the Powerful Law of Attraction

“You are today where your thoughts have brought you; you will be tomorrow where your thoughts take you. ” ~ James Allen

I’ve been thinking quite a bit about the law of Attraction lately and in fact had some manifestations take place of late. That got me wondering how long it will take before the majority of our world population is conscious and understands the Universal truths, one of which is the law of Attraction.

I’ve written about the Law of Attraction many times in the past describing how what we put our focus on and the energy we put out to the Universe the most-whether positive or negative, frustrated or satisfied, in the flow or chaotic-is what we attract into our lives. I’ve also described how the Universe, God, Spirit, Source, Infinite Intelligence, whatever you choose to call your higher spirit, has natural laws that are what you might call “non-negotiable. ”

The object of this article is to introduce you to the Law of Attraction if it’s not yet in your awareness, to help you understand it as best you can or any of us can for that matter, and to help you understand the key to using this powerful Universal law. And, for those who are not yet familiar with the Law of Attraction, I like to use the following analogy about gravity to make it very easy to understand the premise behind the law of Attraction and the fact that it, too, is a non-negotiable Universal law:

We are all very familiar with the Law of Gravity. Gravity is a natural Universal law that affects every one of us 24/7-always has-always will. It’s what keeps us and everything that’s not literally grounded to Earth from floating off into space and in fact is what keeps Earth in its rotation.

So, here’s an example of the non-negotiable truth of the Law of Gravity. If you go up on your roof and jump off, gravity will immediately send you to the hard ground without question. Everyone is aware of this and knows it to be true. So, although we may not understand the exact workings of gravity, it is still a non-negotiable Universal law that no one disputes. And, this analogy is all-telling in terms of the non-negotiable ways of the Universe wouldn’t you say?

The problem is the Law of Attraction seems less concrete or less tangible to people even though it is another equally non-negotiable law of the Universe. It’s based on energies and how they affect all matter, including us. It can be a bit hard to understand and can seem rather mystical, esoteric, or ethereal, but it’s simply one of God’s universal laws that like the Law of Gravity must be accepted as true.

(If you’d like to read a great book that i find best explains how the Law of Attraction works in terms of basic quantum physics and may really make the connection for you, pick up a copy of “The Answer: Grow Any Business, Achieve Financial Freedom, and Live an extraordinary Life, ” by John Assaraf and Murray Smith. )#)

“The Law of Attraction states that whatever you focus on, think about, read about, and talk about intensely, you’re going to attract more of into your life. ” ~ Jack Canfield, best-selling author of “Chicken Soup for the Soul” and “The Success Principles”

The law of Attraction has no control over which thoughts we think-positive or negative-but it is active in our lives 24/7 and responds to whatever we focus on and the energy surrounding it, positive or negative, thus giving us the results we manifest in our lives. Whether we believe in it or understand it or not, it’s always present and always at work.

The beauty of the Law of Attraction though, unlike the law of Gravity that gives us no choice as to whether or not we’ll hit the ground if we jump off that roof, is that we do have the option to choose to dwell in positive energy and positive thoughts, therefore sending positive energy out to the Universe (God, Infinite Intelligence-the higher spirit) and thereby attracting positive events, circumstances, opportunities, and people into our lives.

In other words, if we are positive and feel good, our energetic frequency is high, and we attract what we need to fulfill our dreams. So to manifest your dreams, from the smallest to the largest, do your best to maintain positivity and to feel good and be happy. It’s a short-cut to creating the life you want.

To wrap this up, I’ll mention a couple other critical things to note about the Law of Attraction in order for us to attract the positive events, circumstances, opportunities, and people into our lives to propel us towards whatever desire we’re asking for. First, we must take action towards the results we seek, and second, we must show sincere gratitude for all the blessings we already have in our lives. These steps are as key to our success, fulfillment, and happiness as the thoughts we think and the energy we dwell in.

I hope this article is useful in your journey and attracting the life of your dreams. At some point the majority of the world population will understand the truths of the Law of Attraction even if they can be a bit mystifying to understand. Suffice it to say that when we learn the truths about the Law of Attraction and other Universal laws and put them into practice, we will then be well on our way to manifesting our dreams and receiving all the good the Universe has for us as well as creating an even more amazing world in which to live!

“The best way to overcome undesirable or negative thoughts and feelings is to cultivate the positive ones. ” ~ William Walker Atkinson.
